Implementation Plan for Accelerating the Integration, Optimization and Harmonious Development of Special Customs Surveillance Zones in Yunnan Province
为贯彻落实《国务院办公厅关于印发加快海关特殊监管区域整合优化方案的通知》(国办发〔2015〕66号)精神,主动把握和积极适应经济发展新常态,推动我省海关特殊监管区域整合优化、协调发展,促进区内产业转型升级,制定本方案。
This Plan is formulated for the purpose of implementing the Circular of the General Office of the State Council on Issuing the Proposals for Accelerating the Integration and Optimization of Special Customs Surveillance Zones (G. B. F. [2015] No. 66), actively involving in and adapting to the “new normal” of economic development, pushing forward the integration, optimization, harmonious development of special customs surveillance zones (SCSZs) in Yunnan, and promoting industry transformation and upgrading in SCSZs.
一、 总体要求
I. General Requirements
(一)工作目标
(I) Objectives
稳步推进全省海关特殊监管区域科学发展,形成布局合理、错位竞争、管理规范、通关便捷、用地集约、产业集聚、绩效突出、协调发展的格局。
Firstly, measures will be taken to steadily push forward the scientific development of SCSZs in Yunnan, so as to realize the reasonable layout, complementary competition, standardized management, convenient clearance, intensive land utilization, industrial agglomeration, outstanding performance, and harmonious development of SCSZs.
进一步完善政策、创新体制、拓展功能、优化管理,营造国际化、市场化、法治化环境,促进区内企业参与国际市场竞争,推动海关特殊监管区域量质并举。
Secondly, further improvements will be made in policy formulation, system innovation, function expand and management optimization, thus creating an international environment that is market-oriented according to law, encouraging enterprises in SCSZs to participate in international competition, and building more and better SCSZs.
发挥海关特殊监管区域的要素集聚和辐射带动作用,推进加工贸易转型升级,促进区内产业多元化发展,更好地服务外向型经济发展和对外开放。
Thirdly, SCSZs will be encouraged to play a better role in gathering businesses and driving the development of surrounding areas, thereby promoting the transformation and upgrading of processing trade, diversifying the types of businesses in SCSZs, and accelerating the progress of export-oriented economic development and opening up.
(二)基本原则
(II) General principles
合理配置,协调发展。着眼服务于“一带一路”和长江经济带等国家战略,承接国际和东部沿海产业转移,统筹考虑各地经济环境、产业基础、贸易结构、资源分布、发展规划等实际情况,加强分类指导,因地制宜推进海关特殊监管区域申报、建设和发展。
Reasonable layout and harmonious development. Following relevant national strategies, such as the Belt and Road Initiative and Yangtze River Economic Belt plan, SCSZs shall be built for businesses from abroad and eastern coastal areas, according to the economic environments, industrial bases, trade structures, resource distribution and development plans of different regions in Yunnan, so that SCSZs can better serve businesses in different regions.
注重质量,提升效益。按照转变经济发展方式要求,遵循市场经济规律,合理配置资源。增强海关特殊监管区域发展的内生动力,推动区内企业技术创新和绿色发展,优化产业结构,提升整体效益,充分发挥辐射带动作用。
Quality and efficiency. Resources shall be allocated in a reasonable manner according to the concept of “change of the economic development mode”, and market rules. Internally, the endogenous strength of SCSZs shall be enhanced to promote the technological innovation and eco-friendly development of enterprises in SCSZs, and optimize the industrial structure. Externally, SCSZs shall also drive the economic development of surrounding areas.
深化改革,强化监管。适应国内外经济形势变化,充分发挥海关特殊监管区域在统筹国际国内两个市场、两种资源中的作用,提高依法行政能力,加强监管,防范风险,创新管理理念、管理制度和管理手段,提高服务水平,降低运行成本。
Deepened reform and enhanced supervision. SCSZs shall play the role of linking foreign and domestics markets, and integrating resources from both sides, according to the changes in global economic situation. SCSZs shall also make improvements in legal administration, supervision, risk control, administrative (idea, system and method) innovation, service provision, and cost control.
二、 主要任务
II. Main Tasks
(一)合理规划布局。立足我省经济发展现状,将海关特殊监管区域纳入全省经济发展和产业布局总体规划中,统筹谋划整体布局和功能定位,将其打造成为引导我省加工贸易转型升级、承接产业转移、优化产业结构、拉动经济发展的重要载体。根据全省经济战略总体形势和各地对外开放的局部环境,结合各州、市经济环境、产业基础、贸易结构、资源分布、发展规划等实际情况,以滇中城市群为中心,在昆保芒瑞、昆磨、昆河等3个重点对外开放走廊的重要节点城市科学规划、合理布局海关特殊监管区域和保税监管场所。重点推进昆明综合保税区、红河综合保税区建设工作;有序推进西双版纳、德宏、文山、曲靖海关特殊监管区域研究论证,适时提出申报方案;适时考虑在玉溪、临沧、普洱等地申报海关特殊监管区域。
(I) Reasonable planning and layout. The construction of SCSZs will be included in the general economic development and industrial layout plan of Yunnan according to Yunnan’s current economic situation. The locations and functions of SCSZs will be determined from a systematic perspective, for the purpose of making SCSZs important carriers that guide the transformation and upgrading of processing trade, undertake industrial transfer, optimize industrial structure, and push forward economic development. According to Yunnan’s general economic strategies, and the economic environments, industrial bases, trade structures, resource distribution, and development plans of various prefectures and cities, it’s planned to build SCSZs and bonded surveillance areas in cities in central Yunnan, and key cities and prefectures along the three foreign trade corridors of Kunming-Baoshan-Mangshi-Ruili, Kunming-Mohan, and Kunming-Hekou in line with the principle of scientific planning and reasonable layout. Special attentions will be given to the construction of the Kunming free trade zone (KMFTZ), and Honghe free trade zone. At the same time, investigations will be carried out sequentially for the construction of SCSZs in Dehong, Wenshan and Qujing, so that project construction applications can be submitted at the right time. The construction of SCSZs in Yuxi, Lincang and Puer will also be considered.
(二)严格规范建设。严格按照城市总体规划要求,坚持“合理配置、协调发展”的原则,注重依托基础设施完善、产业布局良好、项目聚集度高、管理规范的开发区、产业园区、重点开放口岸进行规划和建设,注重联动发展。昆明市人民政府负责重点推进昆明综合保税区建设,切实做好规划论证、基础设施建设和招商引资等工作,2016年12月31日前,完成省级项目联合预验,为2017年2月顺利通过国家有关部委联合验收作好准备;加快推进昆明高新保税物流中心和腾俊国际陆港保税物流中心建设,确保2016年11月25日前完成验收。红河州人民政府要本着高效利用和节约土地的原则,严格按照国务院批准的四至范围和规划用地性质对红河综合保税区进行规划建设。特殊监管区域一经验收,严禁擅自增加或改变经联合验收过的有关设施。严格监管入区项目的规划建设,设置容积率和亩均投资强度门槛,严禁“圈地”、闲置土地、抬高地价、抬高租金等行为,切实提高监管区的土地利用效率。
(II) Strict and standardized construction. SCSZs will be built in strict accordance with general urban development plans, and the principle of “reasonable layout and harmonious development”. The design of SCSZs will give consideration to development zones, industry parks, and key ports with well-established facilities, reasonable layouts, intensive businesses, and standardize management, so as to realize the interaction between SCSZs and such zones and areas. The Kunming Municipal People’s Government will take significant measures to promote the construction of KMFTZ, including carrying out project planning and assessment, building infrastructure, and inviting investors and enterprises. It’s planned to complete the joint pre-inspection on provincial-level projects before December 31, 2016, preparing for the joint inspection by relevant national agencies in February 2017. Kunming Bonded High-tech Logistics Center and Tengjun International Inland Port Bonded Logistics Center are also key projects concerned by the Kunming government. Measures will be taken to accelerate the projects, ensuring smooth acceptance before November 25, 2016. The People’s Government of Honghe Prefecture shall design and build the Honghe free trade zone in pursuance of the principle of “efficient land utilization”, and the “four boundaries” and purpose of land use approved by the State Council. In accepted SCSZs, it’s forbidden to change facilities jointly inspected and accepted by relevant organizations. Strict supervision is required on projects in SCSZs. Plot rates and average investment intensity per mu (1 mu = 0.067 ha.) will be set, and behaviors like enclosure, land waste, land price pushing, and rent pushing are forbidden, so as to improve land utilization efficiency.
(三)引导产业聚集。注重精选出口加工和保税业务充分的项目入区,吸引国家鼓励的高新技术产业、战略性新兴产业以及辐射带动能力强的大型龙头企业入区,通过龙头企业带动关联配套企业联动发展,加快形成产业聚集,逐步形成“企业入区、周边配套、辐射带动、集聚发展”的格局。
(III) Guidance to industry agglomeration. Priority will be given to projects focusing on export processing and bonded business, high-tech industries encouraged by the state, strategic emerging industries, and industry leaders that can attract relevant businesses and drive their development, promoting the development of SCSZs. In this way, competitive businesses will be attracted and gather at SCSZs, driving the development of relevant businesses in and out of SCSZs.
(四)优化产业结构。充分研究分析周边(境外)市场需求,鼓励和支持区内企业开展技术创新和产业转型,促进与制造业相关联的销售、结算、物流、检测、维修和研发等生产性服务业有序发展,进一步提高市场占有率。积极承接东部出口加工产业转移,重点发展橡胶和茶叶精深加工、轻工制造、矿产开发、木材加工、机电设备、家用电器、服装服饰、汽配组装等产业。实行差别化产业政策,探索依托国外资源、能源、市场发展“三头在外”的产业模式。适时申请内销选择性征收关税试点,增强区内企业竞争新优势。
(V) Industrial structure optimization. According to the needs of surrounding and foreign markets, supports will be offered to enterprises in SCSZs in technological innovation and industrial transformation. Supports will also be provided to promote the systematic development of such sectors like sales, settlement, logistics, detection, maintenance, and R&D that serve the manufacturing industry, thus further increasing corresponding market shares. Attention will be paid to export processing projects from eastern China, especially projects related to the further processing of rubber and tea, light industry, mineral exploitation, wood processing, electromechanical devices, household appliances, clothes & accessories, and auto parts assembly. Different policies will be provided to different industries according to their characteristics. Besides, projects related to foreign resources, energy and markets will be tried, for the purpose of bringing new competitive strengths to enterprises in SCSZs.
(五)优化业务形态。促进海关特殊监管区域发展保税加工、保税物流和保税服务等多元化业务。支持区内企业利用剩余产能承接境内区外委托加工。促进企业提高统筹两个市场、利用两种资源的能力,助推企业提升创新能力和核心竞争力。积极申请建设贸易多元化功能区试点,赋予区内企业一般纳税人资格,搭建连接国际国内两个市场的桥梁。
(V) Business form optimization. Bonded processing, logistics and service are encouraged in SCSZs to realize business diversity, and the use of extra energy in processing projects consigned by China-based enterprises out of SCSZs is also encouraged. Supports will be provided to help enterprises integrate information and resources form home and abroad, and increase innovation capacity and core competitiveness. Efforts will be made to apply for the construction of multi-functional SCSZ pilots, and give the identity of general taxpayers to enterprises in SCSZs. SCSZs will be built into bridges linking China and foreign markets.
(六)优化贸易方式。鼓励区内企业开展高技术含量、高附加值项目的境内外维修、再制造业务。支持企业运用跨境电子商务开拓国际市场,积极开展跨境电子商务进口业务。支持区内企业开展期货保税交割和仓单质押融资等业务,允许在区内设立保税展示交易平台。支持区内开展融资租赁业务。
(VI) Trade mode optimization. Enterprises in SCSZs are encouraged to undertake maintenance and remanufacturing projects requiring advanced technologies and producing high added value in and out of China. They are also encouraged to expand foreign markets through cross-border e-commerce, especially e-commerce-based import. Business activities like bonded futures delivery, warehouse receipt pledge financing, and finance leases are supported. The construction of bonded exhibition & trade platforms is allowed.
(七)加大政策宣传。加大海关特殊监管区域优惠政策对外宣传力度和招商引资力度。提高各级政府和外贸进出口企业、物流企业等对海关特殊监管区域管理模式、政策法规、运作体系的认知水平,用好用足海关特殊监管区域的功能优势、政策优势。
(VII) Enhanced policy promotion. More efforts will be made to promote the preferential policies of SCSZs, attracting more investors and enterprises. Besides, the management mode, applicable laws, regulations and policies, and operating system of SCSZs will be introduced to governments at various levels, foreign trade enterprises, and logistics enterprises, so that they can have a better understanding of SCSZs, and the functional and policy advantages of SCSZs can play a bigger role.
(八)优化监管服务。创新通关监管服务模式,深化“一线放开”“二线安全高效管住”贸易便利化改革。落实“三互”推进大通关建设,在升级改造区域信息化系统的基础上,优化监管模式,简化通关流程,提高通关效率,为企业生产经营创造良好环境。认真贯彻落实国家和省针对海关特殊监管区域的各项政策措施,严格按照海关、出入境检验检疫、外汇管理、国税、工商等部门的各项规定,为区内企业开展对外贸易等相关业务提供支持和服务,促进区内企业规范经营、健康发展。
(VIII) Supervision service optimization. A more innovative, flexible and efficient clearance supervision mode will be created. Besides, an interactive clearance network combing all relevant agencies will be built based on upgraded regional information systems, so as to optimize the supervision mode, simplify clearance formalities, improve clearance efficient, and create a better environment for the production and management of enterprises. Relevant policies and measures issued by the national and provincial governments for the development of SCSZs will be seriously implemented. And the regulations of the customs, entry-exit inspection and quarantine departments, foreign exchange administrations, national tax agencies, industry & commence agencies etc. will be strictly followed when providing support and services to enterprises in foreign trade. In this way, standardized management and healthy development of enterprises in SCSZs can be realized.
三、 工作保障
III. Guarantee Measures
(一)加大财税、土地政策支持。省财政统筹资金支持海关特殊监管区域建设。对海关特殊监管区域基础设施建设项目贷款享受国家级开发区基础设施建设项目贷款的贴息政策。区内国家重点扶持的高新技术企业,按照国家规定减按15%的税率征收企业所得税。授权海关特殊监管区域以特许经营方式,依法对区内以政府投资建设的市政设施为载体的广告进行经营管理,有关特许经营权的收益可用于区内项目建设。对入区企业,可按照规定免收管理类、登记类和证照类行政事业性收费。区内非营利性公共基础设施用地一律划拨使用,工业用地可采取“先租后让、租让结合”方式提供,租金按照当地工业用地最低价的5%收取。
(I) Enhanced financial, tax and land policy supports. Funds will be raised and provided by provincial finance for the construction of SCSZs. According to national policies, interest subsidy on loans of national development zone infrastructure construction projects is available to SCSZ infrastructure construction projects, and high-tech enterprises encouraged by the state may enjoy a 15% cut in corporate income tax. SCSZs are authorized to, through franchising, manage ads on facilities funded by the government, and corresponding income may be used in the construction of projects in SCSZs. Enterprisers in SCSZs may be exempted from administration, registration and licensing fees. In SCSZs, land use for non-profit public infrastructure construction will be allowed unconditionally. For industrial land, the mode of “Lease before Sell” may be adopted, and the rent/unit is 5% of the minimum local industrial land price/unit.
(二)加强金融服务。探索建立与我省海关特殊监管区域发展相适应的外汇管理方式,实现跨境贸易投资、融资便利化。简化货物贸易外汇业务办理程序和手续。简化跨境人民币审核业务流程,支持企业使用人民币开展跨境贸易结算。鼓励和支持区内符合条件的企业开展跨境人民币资金集中运营业务。将区内进出口企业全部纳入A类企业进行管理,出口收汇不受额度限制。对入驻海关特殊监管区域的金融机构,采取“统一受理、统一审查、快速验收”方式,高效办理金融机构各项外汇业务准入和系统验收工作。
(II) Enhanced financial service. A foreign exchange administration mode suitable for the development of SCSZs in Yunnan will be built, realizing more convenient cross-border trade, investment and financing. Foreign exchange administration formalities related to trade in goods will be simplified. Besides, cross-border RMB audit formalities will also be simplified, and cross-border settlement in RMB will be supported. Qualified enterprises in SCSZs are encouraged to adopt centralized RMB settlement in cross-border trade. All foreign trade enterprises in SCSZs will be categorized as Class A enterprises which are not subject to export collection limits. The entering of financial institutions to SCSZs follows the principle of “centralized application, centralized review, and rapid acceptance”, so as to realize efficient foreign exchange business admission, and system examination & acceptance.
(三)创新管理机制。赋予海关特殊监管区域与国家级开发区、高新区管委会相同的管理权限。海关特殊监管区域根据实际需要和审批能力,提出由省直部门下放或委托行使的审批事项,与省直有关部门协商一致并报省人民政府批准后实施。按照“谁委托、谁监督”的原则,省直有关部门做好跟踪、协调、监督和服务工作,海关特殊监管区域要将审批事项办理情况报省直审批主管部门备案。支持海关特殊监管区域积极探索开展政策与制度创新,通过学习借鉴上海等自由贸易试验区可复制可推广的经验与做法,探索形成以贸易便利化为重点的贸易监管制度、以资本项目可兑换和金融服务业开放为目标的金融创新制度、以政府职能转变为核心的事中事后监管制度。\
(III) Administration mechanism innovation. SCSZs enjoy the same administration rights given to the management committees of national development zones and high-tech parks. SCSZs shall, in accordance with their actual needs and capacity, put forward matters (to be approved) that agencies directly under the provincial people’s government transfer to them or authorize them to handle, discuss such matters with the agencies, and submit them to the provincial people’s government for approval. In accordance with the principle of “authorized party as supervisor”, agencies directly under the provincial people’s government shall track and supervise the whole process, and provide coordination and other supports. SCSZs shall report results to competent agencies directly under the provincial people’s government for filing. SCSZs are encouraged to actively explore policy and system innovation. Experience and methods that can be copied and promoted may be learned from pilot free trade zones like Shanghai Pilot Free Trade Zone, to build trade supervision systems focusing on convenient trade, innovation financial systems aiming at capital account convertibility and the opening of financial service, and overall supervision (during and after the occurrence of an event) systems emphasizing on the transform of government functions.
(四)建立考核工作机制。省商务厅要尽快牵头研究制定我省海关特殊监管区域考核办法,本着“简便易行、便于操作、激励先进、推动发展”的原则,会同海关、出入境检验检疫等部门对各海关特殊监管区域建设发展进行日常监管和年度考核。
(IV) Establishment of an assessment mechanism. The Department of Commerce of Yunnan Province should take the lead in studying and formulating assessment measures for SCSZs in Yunnan as soon as possible, and work with the customs, entry-exit inspection and quarantine department and other relevant departments to conduct daily supervision and annual assessments on the construction and development of all SCSZs through methods which are “easy to be applied, and effective in encouraging enterprises in SCSZ, and promoting the development of SCSZ.
(五)强化任务落实。省商务厅要会同省直有关部门做好业务指导和服务工作,及时督促检查并跟踪了解工作进展情况;省直有关部门要加强协作,密切配合,共同研究解决我省海关特殊监管区域建设发展工作中的困难和问题。昆明市、红河州人民政府要根据本方案要求,结合本地实际,进一步细化工作任务,积极稳妥地推进有关工作,确保海关特殊监管区域整合优化和建设发展取得实效。
(V) Strengthened implementation of tasks. The Department of Commerce of Yunnan Province should work with relevant departments directly under the provincial people’s government to give business guidance and services, and timely supervise, inspect and follow up the work progress. Relevant departments directly under the provincial people’s government should enhance collaboration and cooperate closely to jointly study and solve the difficulties and problems occurring in the construction and development of all SCSZs in Yunnan. Kunming Municipal People’s Government and People’s Government of Honghe Prefecture should further detail tasks according to this plan and based on the local situations, and promote relevant work in a proactive and steady manner, to achieve concrete results in the integration, optimization, construction and development of SCSZs.
