Kunming Municipality on Supporting Development of KMFTZ (Trial)

第一条（目的依据）

Article 1 Objectives and Legal Basis

为切实支持和推动昆明综合保税区（以下简称昆明综保区）及昆明市域范围内设立的海关特殊监管区的建设和发展，根据有关法律、法规，结合昆明实际，制定本政策。

These policies are formulated in accordance with relevant laws and regulations, as well as the practical situations of Kunming, for the purpose of supporting and promoting the construction and development of the Kunming free trade zone (KMFTZ) and other special customs supervision areas in Kunming.

第二条（适用范围）

Article 2 Applicable Scope

昆明综保区（区块一和区块二）适用本政策。在昆明市域范围内设立的其他海关特殊监管区，可参照本政策执行。

These policies are applicable to KMFTZ (District 1 and District 2), and they are also applicable to other special customs supervision areas in Kunming as a reference.

企业享受本政策需在区块属地内完成工商登记注册并独立纳税。

Only companies that have registered at KMFTZ and have been paying taxes independently are qualified to apply for the preferential policies.

区内鼓励企业发展进出口、保税加工、保税物流、保税服务、货物贸易、融资租赁、保税展销、跨境电商等业务。

Supportive policies are given to companies engaged in imports & exports, bonded processing, bonded logistics, bonded service, goods trade, finance leases, bonded exhibition, cross-border e-commerce, etc.

第三条（适用原则）

Article 3 Applicable Principles

凡国家、省市出台的适用于综保区属地的优惠政策，昆明综保区均可适用。对入区企业奖励内容重合时，遵循“同级资金奖励政策不重复适用，其余政策择优或从优适用”的原则。

All the preferential policies developed by the central and provincial governments concerning free trade zones shall apply to KMFTZ. In case a company is qualified for preferential policies issued by different agencies, the principle of “preferential policies at the same level shall not be repeatedly applied, and for those at different levels, more preferential policies shall be applied” shall be followed.

第四条（租赁补贴）

Article 4 Rental Subsidy

对入驻昆明综保区，在区内租赁使用已建成的办公用房且出口额达到500万美元的企业，给予10元/㎡/月的补助。对开展加工贸易、保税物流、服务外包、金融贸易、保税展示交易及跨境电子商务等业务的企业，在区内租用厂房或仓库的，根据实际租用面积，给予租用者20元/㎡/月的补助。单个企业奖励最高不超过200万元。

At KMFTZ, companies that have rented offices, with exports reaching USD5 million can apply for a rental subsidy of RMB10/m2/month; and companies engaged in such realms as processing trade, bonded logistics, outsourced service, financial trade, bonded exhibition and cross-border e-commerce and have rented workshops or warehouses can, according the actual rental area, apply for a rental subsidy of RMB20/m2/month. The upper limit of the subsidy for one company is RMB2 million.

第五条（鼓励类扶持政策）

Article 5 Supportive Policies for Encouragement

在《西部地区鼓励类产业目录》内，属于云南省鼓励类产业的企业，及生产性研发类、临空经济类、电子商务类、服务外包类、金融服务类、生物制药、新型服务业等企业入驻昆明综保区，可享受一次性房屋装修补助，补助标准为100-200元/㎡。其中：世界500强、行业国际排名前20强企业、国内排名前50强企业，按200元/㎡补助；国内排名500强、行业国际排名100强企业，按150元/㎡补助。单个企业奖励最高不超过50万元。

At KMFTZ, companies included in “industries encouraged in Yunnan Province” on the List of Industries Encouraged in Western China, and companies engaged in such realms as production-oriented R&D, airport-based economy, e-commerce, outsourced service, financial service, bio-pharmaceuticals, and new services can apply for an one-off house improvement subsidy of RMB100-200/m2. In detail, Fortune 500 companies, the world’s industry top 20 companies, and China’s industry top 50 companies are granted RMB200/m2, and the world’s industry top 100 companies, and China’s industry top 500 companies are granted RMB150/m2. The upper limit of the subsidy for one company is RMB500, 000.

昆明综保区内的生产加工型企业，新增固定资产投资达到一定规模的，按照以下标准给予相应的生产性扶持奖励：完成投资1-5亿元（含5亿元）人民币且形成实物的，一次性给予企业40万元人民币奖励；完成投资5-10亿元（含10亿元）人民币且形成实物的，一次性给予企业100万元人民币奖励；完成投资10亿元人民币以上且形成实物的，一次性给予企业200万元人民币奖励。

For production and processing companies at KMFTZ, when their investment on newly added fixed assets reaches a certain amount, cash awards will be given as follows: companies that have invested RMB0.1-0.5(inclusive) billion on fixed assets can obtain an one-off cash award of RMB400,000; companies that have invested RMB0.5-1 (inclusive) billion on fixed assets can obtain RMB1 million; and companies that have invested more than RMB1 billion on fixed assets can obtain RMB2 million.

第六条（跨境电商扶持）

Article 6 Support to Cross-Border E-Commerce

经昆明综保区内海关统计跨境电子商务业务达1000笔或金额达10万美金的前50户跨境电子商务企业，每户给予5-10万元一次性补助。入区的跨境电商平台，年销售额达到500万美元以上的给予25万元的一次性奖励。电商平台每引入一家进出口额达100万美元的外贸企业，给予不高于5万元的补助（最高不超过500万元）。对区内跨境电商企业承担的商品检测费用、身份认证费用给予补贴，具体数额由昆明综保区管委会与企业按照交易单量“一事一议”协商。按照不高于2元/单给予补贴，连续扶持2年，单个企业奖励不超过50万元/年，2年后根据企业发展情况和对综保区的贡献再确定是否延长奖励年限。

At KMFTZ, among e-commerce companies with 1,000 or above cross-border e-commerce deals, or with cross-border deals worth USD100,000 according to customs statistics, the top 50 companies can obtain an one-off subsidy of RMB50,000-100,000. E-commerce platforms at KMFTZ with annual sales staying above USD5 million can obtain an one-off subsidy of RMB250,000. When an e-commerce platform introduces one forging trade company with trade volume reaching USD1 million, a subsidy of not more than RMB50,000 will be granted, and the total amount shall not exceed RMB5 million. Commodity inspection and identity authentication subsidy will also be granted to e-commerce companies at KMFTZ according to agreements reached by the KMFTZ Management Committee and specific companies. Generally, the subsidy shall be granted at not more than RMB2/deal for two consecutive years, up to RMB50,000/year. Two years later, this period may be extended depending on the development of the companies and their contribution to KMFTZ.

第七条 （生产性扶持奖励）对于企业进出口给予生产性扶持并由昆明综合保税区制定具体实施细则。

Article 7 Production Support Awards

Awards supporting production related to import/export are given to companies at KMFTZ according corresponding regulations formulated by KMFTZ.

第八条 （物流奖励）对于企业进出口物流给予奖励并由昆明综合保税区制定具体实施细则。

Article 8 Logistics Subsidy

Import/export logistics subsidy is given to companies at KMFTZ according corresponding regulations formulated by KMFTZ.

第九条（行政审批政策）

Article 9 Administrative Approval Policies

对入驻昆明综保区的重大项目实施政务服务“一号申请、一窗受理、一网通办、集中办理、一站式办结”的绿色通道服务。

For major projects at KMFTZ, “one-stop green channel” administrative approval service is provided.

第十条（附则）

Article 10 Supplementary Provisions

企业提出书面申请，与昆明综保区管委会签订入区协议后，按协议确定适用本政策的具体条款。昆明综保区负责对入区企业申报的补助、奖励情况进行收集、汇总、整理、审核和兑付。

Companies with the intention to apply for the above subsides are required to submit a written application. Upon the approval of the application, an agreement will be signed with the KMFTZ Management Committee, and specific subsidy terms and conditions will be included therein. KMFTZ is responsible for collecting, organizing and reviewing the application documents, and the payment of the subsidies.

本政策自昆明综合保税区正式通过国家验收、封关运行之日起开始执行，试行期为二年。

These trial policies shall come into force as of the day that KMFTZ officially comes into operation upon national approvals, and shall be effective for two years.
